Penalties for making "go-arounds" and missed approaches?

Last night, the Torrance City Council continued Item 10A until the December 2 meeting.  This Item seeks to amend the Torrance Municipal Code (TMC) to add penalties for pilots and aircraft that "violate" any part of Airport Ordinance, which illegally attempts to regulate airport operations—an area in which the FAA has EXCLUSIVE authority.

ITEM 10A: Amends Torrance Municipal Code (TMC) to:

The Item calls for any pilot or aircraft which accumulates 3 or more "violations" in a 3-year period to be banished from the airport.  For example, if any pilot or any aircraft makes a "go-around" on any 3 Sundays within the 3-year period, the pilot or aircraft owner may be called before the Hearing Officer.  If the pilot or aircraft owner is found "guilty," their only appeal is to the City Council.  The City of Torrance would be the policeman, investigator, prosecutor, judge, jury and executioner--no real court to evaluate the facts is involved!

The legality of the City's attempts to regulate airport operations is being tested in Federal Court (Zamperini Airfield Preservation Society vs City of Torrance).  A hearing, which had been scheduled for 21 October, was vacated by the judge in order for her to review the 15,000 pages of administrative record on the matter.  The hearing has not yet been rescheduled.  

Until this pending litigation is resolved, it makes no sense for the City to even consider punishment issues.
